Terms of Service

These terms describe what BuildCard Studio agrees to deliver, what we ask in return, and what to do if anything goes wrong. If anything here is unclear, email hello@buildcardstudio.com and we'll explain in plain English.

1. Who we are

BuildCard Studio is a service operated by Maine Provisions Inc, a Maine corporation located at 363 Main Street, Kingfield, Maine 04947. In these terms, "we," "us," and "BuildCard Studio" mean Maine Provisions Inc doing business as BuildCard Studio. "You" means the customer ordering our service.

2. What we agree to deliver

When you submit our intake form and pay the applicable fee, we agree to produce printed-PDF recipe cards based on the materials you submit (your menu, vendor invoices, and any other information you provide). For each menu item, we deliver:

Cards are delivered as PDF files by email within 24 hours of receiving complete submission materials, except where the form or a quote we send you specifies a different timeline.

3. Pricing and payment

Current pricing is listed on buildcardstudio.com. Pricing in effect at the time you submit your order is the pricing that applies to that order. We may change pricing for future orders at any time.

Payment is processed by Stripe and is due on the date of the invoice we send you. Cards are delivered after payment is received.

4. BuildCard Watch subscription

BuildCard Watch is our ongoing monthly service. Every Menu Buildout customer is automatically enrolled in BuildCard Watch at $79/month, billed separately on a monthly cycle starting on your delivery date. You can also subscribe to BuildCard Watch independently if you've previously ordered from us.

Watch includes a monthly cost-review report on your subscription anniversary, alerts for ingredient cost shifts of 10% or more, vendor change notifications, updated cards for affected items, and up to three new menu cards each month (additional cards billed at the standard per-item rate). Unused monthly cards do not roll over.

You can cancel BuildCard Watch at any time by emailing hello@buildcardstudio.com. Cancellation takes effect at the end of the current billing period. We do not prorate partial months. Cards delivered before cancellation remain yours; we keep your portfolio on file in case you return later.

If you cancel BuildCard Watch within seven days of being auto-enrolled following a Menu Buildout, we'll refund the most recent monthly charge.

6. Revisions

Single-item orders include one round of revisions within 14 days of delivery. Menu Buildouts include unlimited revisions within 30 days of delivery. BuildCard Watch subscribers receive priority revisions while their subscription is active. After the revision window ends, additional changes are billed at our standard per-item rate.

We'll fix any errors we made at no charge regardless of the revision window — that's a guarantee, not a revision.

7. Accuracy of cost calculations

Cost calculations are based on the invoices and pricing information you submit. If your invoices reflect what you actually pay, the food cost percentages will be accurate. Where an ingredient or packaging item isn't found in your invoices, we use publicly available pricing data and clearly mark the result as an estimate.

We make our best effort to be accurate, but the cards are reference tools, not guarantees of profitability. Your actual food cost depends on portion control, waste, theft, vendor price changes, and other operational factors that no recipe card can fully account for.

8. Ownership of the cards

Once you've paid in full, the recipe cards we deliver to you are yours. You can print them, distribute them within your business, modify them, and use them however your operation requires. We retain no ongoing rights to the specific content of your cards.

The card design itself — the layout, the visual style, the BuildCard Studio branding — remains our intellectual property. You can't republish the design as your own product or service.

9. Materials you submit

The menu information, invoices, photos, and other materials you send us remain yours. By submitting them, you grant us permission to use them only to produce your cards and to keep them on file for future revisions or reorders. We don't share your materials with anyone outside the vendors listed in our Privacy Policy.

10. Refunds

If we haven't started building your cards yet, we'll refund your payment in full on request.

If we've started but haven't delivered, we'll refund a fair portion based on work completed.

If we've delivered cards and you believe they have a real problem we can't fix through revisions, email us at hello@buildcardstudio.com. We'll work with you to make it right or refund what's fair.

BuildCard Watch subscribers — see Section 4 above for cancellation terms.

11. Things we can't be responsible for

Limited warranty. We provide our cards "as is." We don't promise that they'll increase your profit, prevent loss, or be free of every error. We do promise to fix mistakes we made.

Limit of liability. If something goes wrong with the cards we built and you suffer a loss, our total liability to you is limited to the amount you paid us for the order in question. We aren't liable for indirect or consequential losses — for example, lost profit, lost customers, or business interruption — even if those losses arose from our work.

Your operations are yours. You're responsible for actually pricing menu items, controlling portions, training staff, complying with food safety regulations, and running your business. Our cards are tools to help; they don't replace your management judgment.

12. Suspending or ending service

If you violate these terms — for example, by reselling our cards as your own service or by submitting materials you don't have rights to — we can stop providing service and refuse future orders. We'll refund any unused fees in that case.

You can stop using our service at any time. If you have an active BuildCard Watch subscription, see Section 4 for cancellation.

13. Privacy

How we collect, use, and protect your information is described in our Privacy Policy. By using our service you agree to that policy.

14. Email and communications

We'll email you about your order, your invoices, and your delivered cards. From time to time we may also email you about service updates, new features, or follow-ups on completed work. You can opt out of non-essential email by replying with "unsubscribe" or emailing hello@buildcardstudio.com.

15. Governing law and disputes

These terms are governed by the laws of the State of Maine, USA, without regard to conflict of laws principles. Any dispute that can't be resolved between us will be brought in the state or federal courts located in Maine, and both parties agree to the jurisdiction of those courts.

Before filing anything, please email hello@buildcardstudio.com describing the issue. The vast majority of disputes can be resolved with a conversation and we'd much rather have one than a lawsuit.

16. Changes to these terms

We may update these terms over time. The "Last updated" date at the top will reflect any change. For material changes that affect existing orders or active subscriptions, we'll email you directly. Continued use of our service after a change means you accept the updated terms.

17. The whole agreement

These terms, together with our Privacy Policy and any specific quote we send you, are the complete agreement between us about the BuildCard Studio service. They replace any earlier discussions or proposals on the same subject. If a court finds any part of these terms unenforceable, the rest still applies.
